Distance Sales Agreement

  1. Parties

This Agreement has been concluded between: Meral Kahraman Polat, operating under the brand MaGlea through the website www.maglea.com⁠ (hereinafter referred to as the “Seller”) and the individual who places an order through the website (hereinafter referred to as the “Buyer”).

The Seller operates within the scope of tax-exempt small business regulations under Turkish legislation.

  1. Subject

The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of handmade products prepared upon order placed electronically by the Buyer through the website www.maglea.com⁠.

  1. Nature of the Products

All products offered by the Seller:

  • are handmade,
  • are produced in limited quantities,
  • may be custom-made according to the Buyer’s request.

For this reason, the products are not mass-produced items.

  1. Order and Payment
  • Orders are placed through the website.
  • Payment method is bank transfer / EFT.
  • If payment is not completed within 24 hours, the order will be automatically cancelled.
  • The preparation process of the product begins after the payment has been received.
  1. Delivery
  • Products are shipped after the custom preparation process is completed.
  • Delivery time may vary depending on the production process.
  • The Seller is not responsible for delays caused by the shipping company.
  1. Right of Withdrawal and Return Conditions

Under the legislation regarding distance sales, consumers normally have the right of withdrawal. However:

Products custom-made according to the Buyer’s request are legally excluded from the right of withdrawal.

Therefore:

  • There is no right of withdrawal or return for custom-made products.

However, the following situations are exceptions:

  • The product is defective,
  • The product is not produced according to the order,
  • The product is damaged during shipping.

In such cases, the Buyer may exercise their legal rights by notifying the Seller.

  1. Damaged Delivery Procedure

The Buyer is obliged to:

  • Inspect the product in the presence of the courier upon delivery,
  • Request a damage report from the courier if damage or missing parts are detected,
  • Send the report and relevant photos to info@maglea.com within 2 days after delivery.

If this procedure is not followed, the Seller cannot be held responsible for damages caused during shipping.

  1. Limitation of Liability

The Seller shall not be held responsible for situations arising from:

  • improper use of the product,
  • incorrect or incomplete information provided by the Buyer,
  • delays caused by the shipping company.

  1. Force Majeure

In cases of force majeure such as natural disasters, fire, strike, war, infrastructure failures, or other circumstances beyond the control of the parties, the obligations of the parties shall be temporarily suspended.

  1. Resolution of Disputes

In disputes arising from this Agreement:

  • The laws of the Republic of Türkiye shall apply.
  • In consumer disputes, Consumer Arbitration Committees and Consumer Courts at the Buyer’s place of residence shall have jurisdiction.

  1. Entry into Force

By placing an order through www.maglea.com⁠, the Buyer is deemed to have read, understood, and accepted all terms of this Agreement.
